      RENTAL AGREEMENT

      PARTIES

      The parties to this agreement are determined as Els Villas, Customer and Visitor. The parties are defined as specified in the agreement.

      VISITOR

      The term refers to, but is not limited to, real or legal persons who examine, request to purchase or rent, or purchase or rent services, rental villas, apartments, residences and workplaces or other materials that can be purchased on our site.

      CUSTOMER

      Refers to the customer who publishes the advertisements of villas, apartments, residences and other services on our website, directly through us or through them,

      or who benefit from our services indirectly through our sites, through Els Villas, of real persons or legal entities, to be rented through our site. Customers are also people who rent.

      RESERVATION PAYMENT

      30% of the total reservation fee for the villa/apartment/facility you have made a reservation for must be paid in advance with the reservation by credit card or bank transfer.

      The remaining payment amount is paid in CASH on the day of entry to the facility. If the rental fee is in foreign currency and the visitor wants to make the payment in TL, the central bank daily sales price will be taken as basis.

      DAMAGE DEPOSIT

      A damage deposit fee has been determined for all reservations made, this amount varies between 250 TL and 2,000 TL depending on the types of apartments or villas.

      The person making the reservation pays the damage deposit in CASH upon entering the villa/facility.

      On the day the guest leaves the villa/facility, an authorized person from the company or the host/responsible person checks the villa/facility, and the damage deposit refund (if there is no damage)

      is paid upon exit.

      CHECK-IN - CHECK-OUT TIMES AND DATES --- CHECK-IN AND CHECK-OUT

      Entry to the properties (Check-in) must be after 16:00, and exit (Check-out) must be at 10:00.

      The remaining time period is reserved for cleaning the properties and the entry of the next visitor. Only in appropriate cases, late exit or early entry is allowed. Otherwise, the visitor must exit at the specified time. In case of late exit, the visitor accepts and undertakes to pay any losses that may arise from this situation.

      For receptions after 19:00 (until 23:59), if the company's approval is not received,

      Els Villas has the right to request an extra 450 TL reception overtime fee. The villa cannot be entered without paying this fee. VISITORS are obliged to make their arrival time coincide with these hours before setting off. (Entrances after 23:59 are not accepted.)

      CLEANING

      All villas are delivered clean upon arrival.

      SPECIAL REQUESTS

      Your special requests and demands must be notified during the reservation. We state that maximum effort will be made to meet your special requests and demands.

      PHOTO ACCURACY AND RESPONSIBILITY

      The host undertakes that the villa photographs uploaded to the "Els Villas" site are exactly the same as the current status of the villa and provide accurate information to the guests. If any inconsistency is detected between the villa in the photos and the real villa, the host will cover the damages experienced by the guest and will take the necessary measures to provide an appropriate solution.

       

      CONCLUDING THE CONTRACT

      *The visitor accepts that he/she has read, understood, and is aware of his/her rights and obligations.

      *The visitor accepts that there is no disproportion between the acts agreed upon in the contract and that the mutual acts are in accordance with the nature of the work, and that they do not have any inexperience in the transactions covered by the contract.

      *The visitor accepts that he/she has reached a full conclusion that the transactions covered by the contract are in his/her own interest

      and that he/she will comply with all the terms of his/her own free will, without any difficulty or distress, thoughtfully, willingly and knowingly.

      *Els Villas Rental and the visitor accept that the terms of the contract do not have a feature that can be considered as unfair terms, and that there is no injustice in terms of the balance of interests.

      The provisions of this contract do not contain any unfair terms in accordance with the provisions of the regulation on unfair terms in consumer contracts.

      The provisions do not constitute a violation of the principle of honesty and good faith and have been prepared in accordance with the consumer protection legislation.

      The provisions of this contract have been prepared by taking into account the provisions of the Code of Obligations No. 6098. The binding

      and content control stipulated in Article 21 of the Code of Obligations have been carried out by the visitor. None of the provisions of this contract are foreign (surprising terms)

      to the nature of this contract and the nature of the work. The provisions of this contract are written in a clear and understandable manner and do not express more than one meaning.

      OUR COMPANY'S RESPONSIBILITIES

      *All transactions related to this reservation from the date of reservation made through our website (www.elsvillas.com.tr) until the entrance to the villa are the responsibility of our company.

      * It repairs or maintains any possible malfunctions in the residence (electrical failure, water failure, etc.) as soon as possible.

      However, we would like to remind you that delays may occur due to the very busy summer months.

      * Our company is not responsible for the personal belongings of the visitors in any way. We recommend that our guests be careful, considering that there may be theft incidents in holiday resorts.

      * We recommend that you have travel insurance. In case of theft, damage or similar conditions of the belongings belonging to the house, the action will be taken according to the report of the police or gendarmerie investigating the incident.

      * We would like to state that we will not accept responsibility for changes resulting from situations such as war, threat of war, social unrest, terrorist acts, natural disasters, health risks and severe weather conditions that are completely out of our control, and that we will not make refunds.

      * In case of major technical malfunctions that occur in the house and cannot be repaired, another housing equivalent to the rented house will be allocated by our company.

      * All our villas located in nature are regularly sprayed. However, the possibility of butterflies, insects, flies, bees, scorpions, ants etc. in the environment should be taken into consideration due to seasonality and location.

      Our company will not be held responsible for this situation.

      *No villa or apartment published on the Els Villas website belongs to Els Villas. The owners of each villa/apartment are different real or legal persons.

      Els Villas acts as an intermediary to rent the villas/apartments of real or legal persons to the customer.

      Therefore, Els Villas

      only issues a brokerage invoice. A certain amount of the amount paid by the visitor is (brokerage) income and Els Villas presents an invoice based on this income.

      Since the remaining part of the total amount paid by the visitor that is not invoiced is the income of the villa/apartment owner,

      no invoice is presented for the remaining amount.

      The villa/apartment owner pays its tax to the state at the end of the year under the name of rental income declaration. Since Els Villas issues an invoice for the income it earns, it does not issue an invoice for the income earned by third parties, institutions, individuals, companies, and it has no liability arising from this situation.

      Els Villas is responsible for the villa/apartment/apartment being delivered to the customer on the specified date and time, clean and ready for use. Upon entering the villa/apartment/apartment, if there is any broken, non-working item or malfunction, the customer must immediately notify Els Villas and request that these malfunctions be fixed. Els Villas will notify the villa/apartment/apartment owner or the relevant company of this request and ensure that this malfunction is fixed within 72 hours at the latest. Els Villas is not responsible for fixing the malfunction, it helps to fix the malfunction. Els Villas cannot be held responsible for malfunctions that are not reported on time. As a company, Els Villas acts as an intermediary between the villa/apartment/flat owner and the customer, and therefore the villa/apartment/flat owner is responsible for resolving any problems that may occur in the villa/apartment/flat. Apart from this, the customers are responsible for any problems that may arise.

      Els Villas is responsible for delivering the villa/apartment/apartment to the customer on the specified date and time, clean and ready for use. Upon entering the villa/apartment/apartment, if there is any broken, non-working item or malfunction, the customer must immediately notify Els Villas and request that these malfunctions be fixed. Apart from this, any accidents, illnesses, injuries, drowning in the pool, death, theft, falls, etc. that may occur and are the responsibility of the customers. and Els Villas Company cannot be held responsible for any fire, theft, etc. incidents and accidents that may occur in the villa/apartment/apartment. Apart from this, Els Villas will not be held responsible for any problems that may arise from any service such as trip, shopping, food, beverage, entertainment, transportation, travel, guidance services, etc. that the customer receives from third parties/companies during their arrival to the villa/apartment/apartment, their return, during their holiday. After leaving the villa/apartment/apartment, the customer cannot claim any rights or refunds for a service that they could not receive due to a malfunction or failure that they did not notify Els Villas about during their stay in the villa/apartment/apartment.

      VISITOR RESPONSIBILITIES

      * Smoking is prohibited inside the house.

      * Pets are not allowed unless approved by our company.

      * The maximum number of people for each house is stated on our website. No one else should stay in the house except for the persons specified in the contract, and the visitor should not exceed the number of people specified in the reservation form and/or on our website for the house they rent.

      * Visitors are authorized to use all the belongings and furniture of the holiday home they rent. However, they should take care to use all the equipment cleanly and without causing any damage. They should notify our company in case of any damage.

      * The cost of any damage that occurs will be deducted from the deposit. If the damage cost is higher than the deposit, the visitor agrees to pay the excess.

      *Visitors cannot transfer their rights and obligations arising from this Contract without the approval of Els Villas Company. Els Villas Company may transfer its rights and obligations arising from the contract to third parties.

      *The user must protect the real estate in accordance with the law and general moral rules, in a clean, careful and meticulous manner and in accordance with the agreement and understanding, as if it were their own property, and keep it away from all possible dangers.

      *If the real estate is not used as his/her own property in a clean, careful and meticulous manner and in accordance with the agreement and understanding and is not kept away from possible dangers while it is left under the control of the visitor for use, the visitor will be liable to the extent of his/her fault against the Real Estate Owner, and Els Villas will definitely not be liable.

      *The real estate will be used only by the visitor and the persons specified in the contract. Unless there is a condition that persons other than the persons specified in the contract can also be used, the real estate cannot be used by anyone else. Even if there are permitted persons, these uses cannot be allocated by the visitor to third parties for a fee. If there is a condition that persons permitted by the visitor can also be used, the actions of the said permitted persons contrary to the provisions of this Agreement will be directly

      considered as a violation of the visitor.

      The user cannot make commercial or similar gains by allowing others to use the real estate.

      * Visitors should be understanding towards the neighbors around the house used and avoid any behavior or noise that may disturb the environment.

      They should also not engage in any illegal activity that is prohibited by law (weapons, drugs, any kind of smuggling, etc.). In such a case,

      Els Villas Company reserves the right to evacuate the house immediately and without warning. Els Villas cannot be held responsible for any damages and losses that may occur during the evacuation due to the above reasons.

      This agreement guarantees that the house will not be rented to anyone else during the dates in question. In case of disaster and force majeure, this agreement will be invalid.

      *Els Villas cannot be held responsible in cases where Els Villas cannot prevent such as the roads leading to the villa/apartment being bad, uphill, stabilized, wet ground, etc.

      *Els Villas cannot be held responsible for any accidents that may occur during transportation to the villa/apartment, in short, any kind of negativity.

      *In the event that different materials used in the construction of some villas (cedar tree, pine tree, some plastic products, any kind of plant in the garden or inside the villa, etc.) disturb the customer healthily or psychologically, Els Villas cannot be held responsible for this incident.

      *Customers who will stay in all our Villas and Apartments will need a private vehicle. The customer's transportation to the villa/apartment is his/her own responsibility. Els Villas never, under any circumstances, transports the customer to the villa/apartment they rent in the Els Villas Company's car. The customer may obtain a taxi, transfer vehicle or rental car from third parties. Els Villas does not interfere with the transfer or taxi service to be rented or rented from third parties.

      It is the visitor's own responsibility.

      *Els Villas cannot be held responsible if the customer who rented a villa or apartment is dissatisfied with the geographical location of the villa or apartment they rented.

      Els Villas Company has marked the location of the villa/apartment approximately on Google Map

      Els Villas cannot be held responsible for damage to the private or rented vehicle during transportation to the villa/apartment.

      * The bottom of the vehicle (motor, car, etc.) of the customer who rented the villa/apartment is close to the ground,

      the engine power of the vehicle is weak, the customer; car, motor, etc. Any negativity that may occur due to inexperience in using it and not being able to reach the villa/apartment is the responsibility of the customer. Els Villas cannot be held responsible for such or similar problems.

      *Unless otherwise stated, the swimming pools of our villas/apartments are not heated. Their temperatures vary according to seasonal conditions, and Els Villas cannot be held responsible in any way if the customer cannot use the pool due to the temperature or coldness of the pool water. Before renting the villa/apartment, the customer can get information about the weather conditions from the website or phone of the General Directorate of Meteorology.

      Explanation regarding special situations:

      FUMIGATION OF THE HOUSES:

      All of our villas located in nature are regularly cleaned and medicated for insects and pests. However, in these types of houses located in nature, the probability of insects etc. is higher compared to villas located in the center.

      CONSTRUCTION:

      There may be new villa constructions in the regions outside the summer months. For this reason, there is likely to be noise around. Please remember that you should take precautions yourself in case of allergies.

      POOL AND GARDEN MAINTENANCE:

      Pool spraying is done by the host or the person in charge. Pool checks and frequency vary according to criteria such as the type and size of the pools, but generally chlorine is thrown every other day and the pool bottom is cleaned. These checks are usually done by the relevant person in the early hours of the morning without disturbing you. In villas with a garden, garden watering and maintenance is also done by the host or the relevant person in charge. This process is also usually done in the early hours of the morning without disturbing you.

      AREA RESEARCH:

      Before your check-in, we send information about the villa to your e-mail address. However, please remember that many villas are located in high places within the village. Therefore, we recommend that you do research about the area before arriving.

      INTERNET CONNECTION:

      There is internet connection in most villas, but there may be interruptions and slowdowns due to the infrastructure of holiday regions.

      ELECTRICITY AND WATER OUTAGES:

      In some holiday resorts, especially during very busy periods, water and electricity outages may occur because the regional infrastructure is not strong enough. If there is a generator in a house, this information is also included.

      POOL PROTECTION:

      The pools of the villas we have specified as fully protected are not visible from the surroundings. It is also suitable for our conservative families. The pool areas of the houses we have specified as protected are options where the pool part is visible, albeit slightly. Pool protection is only provided for the pool. It does not mean that the villa or the garden is protected.

      Pictures and videos of the houses:

      You can find the exact pictures and videos of that house on our houses page. Some of our villas are located on the site and there are many objects furnished in the same or similar way. In such cases, common photos and videos may have been used. In this case, this information is stated on our page. Photographs are generally taken with a wide-angle lens, so they may appear larger than usual. The dimensions of the pool are stated on the house pages.

      Deposit:

      The deposit is a fee received by the owner or the attendant after the house is checked at the entrance. The owner or the attendant checks the house before leaving at the end of your holiday. Unless there is any damage, this fee is returned to you in full upon departure.

      LEGAL CONDITIONS

      a. Applicable Law: The parties agree that disputes regarding the implementation and interpretation of this Agreement will be resolved in accordance with the laws of the Republic of Turkey.

      (b) Competent Court: Fethiye Courts and Enforcement Offices are exclusively authorized to resolve disputes arising from this Agreement. Any complaints and objections regarding this Agreement may be made to the Consumer Problems Arbitration Board or the Consumer Court at the place where Els Villas is headquartered, according to the monetary limits determined by the Ministry of Customs and Trade in December of each year.

      (c) Separability: If any or part of the non-essential provisions of the Agreement are partially or completely

      legally invalid and it is understood that the remaining provisions of the Agreement are enforceable without this provision or part, this situation will only apply to the provision or part in question and will not affect the validity or enforceability of the other provisions of the Agreement.

      (d) Language of the Agreement: This Agreement has been prepared in Turkish and signed electronically.

      (e) Integrity of the Agreement and its Annexes and Amendments: The annexes of the Agreement will constitute an integral part of this Agreement and cannot be interpreted separately from each other.

      (g) Consumer Relations: Els Villas will make every effort to resolve any problems that may arise between the visitor and Els Villas within the framework of good faith and honesty. However, for complaints and objections,

      the Fethiye consumer problems arbitration board or consumer court, where Els Villas is headquartered, may be applied to.

      The visitor does not have the right of withdrawal within the scope of this Agreement, as it falls into exceptional circumstances where the right of withdrawal cannot be exercised in accordance with the provisions of the Regulation on Distance Contracts.

      (h) Transactions made through www.elsvillas.com.tr and transactions in the nature of declaration of intent are considered as declarations of intent binding the Parties in accordance with the Code of Obligations No. 6098,

      Consumer Legislation and other legislation in force.

      In line with the above-mentioned articles, Els Villas cancels the contract without a refund.

      The parties declare that they accept all contract provisions electronically in advance.
