INFORMATION TEXT ON THE PROTECTION OF PERSONAL DATA

1. Purpose and Scope of the Policy

Personal data, within the scope of the Law on the Protection of Personal Data No. 6698 (“LPPD”), refers to any information related to an identified or identifiable natural person. According to the provisions of the LPPD, the natural or legal person who determines the purposes and means of processing personal data and is responsible for the establishment and management of the data recording system is considered as the data controller. (“Els Villas”) as the data controller, within the scope, purposes and legal reasons explained below. In this Information Text document, the Website will be referred to as the “Platform”.

This Information Text has been prepared for the purpose of informing the real persons whose personal data Els Villas processes as the data controller within the framework of Article 10 of the KVKK and the Communiqué on the Procedures and Principles to be Followed in Fulfilling the Information Obligation. Being transparent and accountable is important for Els Villas. In this context, the Information Text includes information on the identity of the data controller and its representative, if any, the purpose for which personal data will be processed, to whom and for what purpose personal data may be transferred, the method and legal reason for collecting personal data, and other rights of the relevant person listed in Article 11 of the KVKK.

Els Villas may update the Information Text in case of changes to the applicable legislation, decisions of the Personal Data Protection Board, court decisions, changes in the methods, purposes and reasons for processing and/or transferring personal data, or similar developments. In case the Information Text is updated, the current text will be published on the Platform. Els Villas may publish other information texts, rules, conditions or other explanations on the Platform within the scope of its activities related to the processing and/or transfer of personal data. 2. Personal Data Collection Methods and Legal Basis

Ensuring the security of personal data is one of our primary goals. Your personal data is processed by Els Villas in accordance with the provisions of the Constitution of the Republic of Turkey, KVKK, Law No. 6563 on the Regulation of Electronic Commerce, Turkish Penal Code No. 5237 and relevant legislation.

Els Villas may collect personal data through the Platform, authorized agencies, service providers, intermediary service providers, social media accounts, cookies, call center, messaging programs on the Platform, notifications from administrative and judicial authorities and other communication channels; visually, audibly, physically, electronically, verbally or in writing; for the purposes of establishing commercial relations, receiving job applications, making offers, establishing contractual relations, fulfilling its obligations arising from the law and/or within the framework of its legitimate interests; in accordance with the personal data processing conditions specified in the KVKK and in line with the legal reasons specified in this Disclosure Text.

Customer (Including Consumer / Guest / Guest etc. Adjectives) Information

Name, surname, nationality, date of birth, Turkish Republic identity number, passport number, driver's license, gender, reservation information, purchase information, invoice information, delivery information, travel information, travel dates, accommodation information, location information, reservation information, customer transaction information, type and number of travel documents, start and end dates of validity and your personal data regarding the country of issue; call center records, credit card statements, counter receipts, customer instructions, records recorded in channels related to this, etc. personal data, information and records collected within the scope of requests and complaints and the results of these, and the website password and passcode information you created while using our services offered in digital environments.

4. Purposes of Processing Personal Data

Pursuant to the KVKK, personal data cannot be processed without the explicit consent of the relevant person as a rule. Els Villas processes your personal information in the cases and to the extent permitted by law.

Within this framework, the purposes of processing your personal data are as follows:

To confirm the identity information of the person who makes a villa/hotel reservation and on whose behalf the villa/hotel reservation is made through the platform,
To record the address and other necessary information for communication,
To carry out the processes for the establishment and execution of the contract,
To communicate with our customers regarding the conditions, current status and updates of the contracts we have concluded under the relevant articles of the Law on Distance Selling Contracts and Consumer Protection, to be able to provide the necessary information, to fulfill the obligations undertaken pursuant to the contracts we have concluded,
To organize all records and documents that will form the basis of the transaction in electronic or paper format,
To be able to provide information to public officials upon request and as required by legislation on matters related to public security,
To provide a better service to our customers, to inform our customers about our products that may be of interest to our customers by taking into account their areas of interest, to convey campaigns,
To inform our customers via e-mail or text message within the framework of the Law on the Regulation of Electronic Commerce and the relevant legislation,
To increase customer satisfaction, To be able to get to know our customers from the Platform and use it in customer circle analysis, to use it in various marketing and advertising activities and to organize surveys electronically and/or physically through contracted institutions within this scope,
To be able to offer suggestions to our customers through our contracted institutions and solution partners, to inform our customers about our services,

In addition to these, our employees' personal data can be processed without obtaining consent to the extent necessary for business relations. The terms and conditions specified in the Employees' Personal Data Protection and Processing Policy apply to the processing of our employees' personal data.

5. Our Company's Rights and Obligations Arising from the Law

Our Company processes personal data in accordance with Article 20 of the Constitution and Article 4 of the KVKK;

In connection with the processing purposes,
In a limited and proportionate manner,
Preserved for the period stipulated by law or required by the purpose of processing personal data, it is processed and transferred based on the conditions specified in Articles 5 and 6 of the KVKK.

 

Personal data shared with Els Villas is under the supervision and control of Els Villas. Els Villas has assumed responsibility as the data controller to establish the necessary organization and to take and adapt technical measures in order to protect the confidentiality and integrity of information in accordance with the relevant legislation in force. We would like to state that we have taken the following administrative and technical security measures, being aware of our obligation in this regard. In this context, we would like to inform you that we always update our data processing policies.

Els Villas stores the personal data it processes for the periods specified by the legislation, and if no period is specified in the legislation; personal data is stored for the period required to be processed in accordance with the practices and customs of Els Villas' commercial life, depending on the services provided by Els Villas while processing the relevant personal data, and after this period, only for the periods determined to be necessary in practice in order to constitute evidence in possible legal disputes. After the expiration of the specified periods, the personal data in question is deleted, destroyed or anonymized.

6. Transfer of Personal Data

The sharing of personal data with third parties is carried out within the framework of the applicable legislation and/or the explicit consent of the relevant persons. However, due to our legal obligations and limited to these, personal data is shared with courts and other public institutions. In addition, personal data is transferred to third parties within the framework of a contractual relationship in order to provide the services we undertake and to perform quality control of the services provided.

Necessary technical and administrative measures are taken to prevent data breaches during data transfer to third parties. For example, SSL and transport layer are used during data transfer.

Your personal data may be shared with program partner institutions and organizations that we cooperate with in order to carry out our activities, third parties that have the title of service provider and/or intermediary service provider, our business partners that provide special integrator services, third parties that provide independent auditing, domestic persons and institutions from which we receive data storage services in the cloud environment, domestic institutions with which we have agreements regarding sending commercial electronic messages to our customers, our financial advisors, the Interbank Card Center, banks with which we have agreements, payment service providers and various domestic agencies, advertising companies and survey companies within the scope of various marketing activities in order to provide you with better service and ensure customer satisfaction, and other domestic third parties and our relevant business partners, shareholders and affiliates, and third parties from whom we receive services within the scope of a contractual relationship, our lawyers, consultants and legally authorized public institutions and private law legal entities.

7. Rights of the Relevant Person

According to Article 11 of the KVKK, the relevant person;

a. To learn whether personal data has been processed regarding him/her,
b. To request information if personal data has been processed regarding him/her,
c. To learn the purpose of processing personal data and whether they are used in accordance with their purpose,
ç. To know the third parties to whom personal data is transferred domestically or abroad,
d. To request correction of personal data if it is processed incompletely or incorrectly,
e. To request deletion or destruction of personal data if the reasons requiring processing are eliminated despite the fact that it has been processed in accordance with the Law and other relevant provisions of law,
f. To request notification of the actions taken as a result of requests for correction, deletion and destruction to third parties to whom personal data is transferred,
g. To object to the emergence of a result against the person by analyzing the processed data exclusively through automated systems,
h. To request compensation for the damages incurred due to the processing of personal data in violation of the law.

 

In order to exercise these rights, you may submit your request in this direction in accordance with Article 13 of the KVKK and the Communiqué on the Procedures and Principles of Application to the Data Controller to the address of Els Villas “Taşyaka Mahallesi Bahaşıkman Caddesi No:76-E Fethiye/ Muğla” by attaching your name and surname and signature, your Turkish Republic identity number if you are a citizen of the Republic of Turkey, your nationality if you are not a citizen of the Republic of Turkey, your passport number or your identity number if any, your place of residence or workplace address for notification, your e-mail address and telephone number for notification and the subject of the request and the necessary information and documents to determine your identity and/or by using the Application Form in writing, via the e-mail address where your membership is confirmed or, if you do not have any membership, via e-mail to receive general information on KVKK. Your application will be evaluated by Els Villas and finalized free of charge within thirty days. However, if the transaction requires an additional cost, the fee determined by the Personal Data Protection Board may be requested.
